I have been wanting to purchase a Nintendo Switch for ages, I actually wanted it for launch.

A website Gameseek had the console priced at £198 (rrp279.) For weeks before the launch and GS encouraged customers to subscribe to their stock alerts to purchase at the lower price to get a console on the launch date. They then announced they were doing a 'ballot' type system where people picked at random would be emailed a link to allow them to purchase at the 198 price in time for the launch.

So anyway I didn't get an email. So I wouldn't be getting one on launch, if I'd known I would've just bought one at Rrp to get one on launch, however the £198 was so good I was happy to wait after launch to get one at this price.

I email GS asking if their next batch after launch will be at the 198 price to which they clearly responded saying yes it would remain at this price. So I thought ah great, I'll wait then for their next batch and hopefully purchase at this price before that stock runs out.

Today GS have priced their next batch, arriving in 10 days at the RRP (well I think a pound or so under.)

Am I within my right to complain as the email clearly states the price would remain at 198.

I could have ordered from Very, spread my finance and got 10% off ages ago, now Very are saying their next available stock isn't coming until the end of April.

I totally understand I wouldn't have been guaranteed one at the 198 price as it'd be first come first serve but I still feel cheated.

Any advice appreciated.

Until you enter into a contract there is no obligation, you do not actually need to have money change hands, if their website accepted an order and sent you a confirmation of that order then the contract would have been entered into.

However, you can imagine that they would have sent you terms and conditions saying that prices were subject to change.

It really does look like a publicity stunt, I can see that In mid january they issued PR statement suggesting it might be a mistake, but say they will honour orders

Sounds reasonable except that they carry on promoting the SALE not the LOTTERY at the £198 price right up to February 24th calling it "the console deal of 2017".

You are doing the right thing to name and shame them with their shoddy treatment of you, another option is to reply to their tweets and relating them to your bad experience. "Well that is all very well but how can consumers trust you when you do not honour prices" with a link to this thread.

If you have a screen shot of their email you can screenshot it, then include it in your tweets.

I would also complain to the ASA, they do cover websites and website generated communications (email), this certainly has a bit of a ripe smell about it. Start by creating scarcity, then say there has been a mistake but will honour price, then carry on selling at the mistaken price right up to 24th Feb, over 40 days later!

I am fairly sure promotions such as lotteries have to adhere to strict terms and conditions but that may only apply to free products. I cannot see any terms page referred to.

I think what they did is absolutely rotten to create expectation and then disappoint.

If you have that email I would be calling Stephen Staley out to honour the email his company sent you.
