Unauthorised money taken mwsf.co.uk

I applied for a payday loan, then decided it wasn't a good idea, as I would be better just selling some stuff on ebay to cover my outgoings. I applied via what seemed a quite reputable firm, but they have handed my card details onto a firm called

mwsf.co.uk, who are basically, these people :

EQI Independent Ltd trading as Moneywarehouse PO BOX 290, Cheadle, Cheshire

Anyway they have basically stolen 36.31 from my account today, meaning I can't go shopping (yes sad and broke I know) and my bank the Natwest, just couldn't care less.

Anyone have any input, or can help ? Thanks

    What was the money taken for?

    You voluntarily proved the card number for debits to be made - if the amount taken was in error, you ask for it back. There is no theft involved, so not a police matter.

    You voluntarily proved the card number for debits to be made...I think the point is, I didn't. As a side note, I used to work as fraud protection officer for a bank, internet banking, and wrote guidelines to prevent phishing.

    You say you had decided it wasnt a good idea so did you contact them to say could you cancel the loan ?

    Have they stolen it though ? You handed over your card details though.

    Im guessing you applied via a loan broker site.

    What did Natwest say when you contacted them ?

    Hardly smug! Fact, yes!

    Did you read the terms and conditions on the site you applied on?

    Likely a broker site and this likely their fee.

    Have you written to moneywarehouse requesting a refund as detailed in their T&Cs?

    Re the shopping aspect of it, do you have any food at all in the cupboards etc ? What money do you have to buy food with ?

    You might be better off looking at the old style board for food ideas.
  • The £36.31 is their broker fee and is a lot less than other brokers. You are entitled to have all of it back except £5 if you follow their terms and conditions - that is the law. In this case, they don't even mention retaining £5 so it may be that you get it all back, and they want you to request it in an email rather than in writing, this is the email address [EMAIL="customerservice@MoneyWarehouse.co.uk"]customerservice@MoneyWarehouse.co.uk[/EMAIL]

    If in fact you are saying that you applied via another site which did not make it clear that there would be a fee, then that may be another matter, but frankly I think it is far more likely that the terms were clear enough. You did, after all, enter your card details.

  • Two issues:

    First, if the OP says the debit to their account was unauthorised then the bank must refund it unless they can show it was more likely than not that it was authorised. This is in FCA rule BCOBS 5.1.11R, which has the force of law. If they do not the OP can ask the FOS for assistance.

    Second. The OP can complain to the firm that took the money. As this is a consumer credit issue, FOS has jurisdiction over them too.

    However, FOS will only intervene if the OP first complains to the business and does not receive an outcome that is satisfactory within 8 weeks.

    Ok, I appreciate the answers, and I appreciate stating the 'fact's and the fact that I was 'stupid' may be a variable.

    I'll break down what happened in a sort of scenario way, but at no time did I directly give these people my card details.

    It worked a bit like this...I rang up a shop and paid for a potato over the phone, they recorded my card details on some paper, to enter into their machine later one.

    In the mean time, the shop gave the details to the shop next door, who charged me money, 'in case I wanted to buy a carrot'.

    Simple enough ?
