Property

My wife and I have separated, but she has put the
House up for sale, but I'm not on the mortgage,
I have bank statements for which I was paying 800-900
A month into her account, an I entitled to anything.

    not enough information .....how long have you been married? were you living together before marriage? how long in total? any children? have you seen a solicitor regarding the separation/divorce?

    You need to look at the overall divorce settlement, not the house in isolation.
  • We have been married for 6 years with 2 children 1 of 6 an 1 of 2, I have not yet been to a solicitor as of yet

    Who owns the property? Not name on mortgage - name on the Title.

    If you wife, then she can sell.

    You need to get legal advice fast so that the sale can be delayed, legally, until your divorce settlement is finalised. Otherwise she could sell and vanish with the money.....

    Go and see a local solicitor who deals with 'Family' law. Tomorrow.

    - you are married
    - you are separating
    - do you want a divorce? If not, what do you want, and how do you expect to get it?

    you need legal advice to make sure the children's future is protected both in terms of having somewhere to live and still having a dad. That should be the first priority.

    Then you can sort out the split of money between you and her via the "financial settlement" which is a separate element of the actual divorce.
