Unpaid Widows Pension

Advice please as to next step.
My step father passed away in January, ( I am an executor of the will with my sister), and when we notified the pension company of his death we then received a letter to inform us of an over payment, as he had died before the payment. This was paid back immediately, and since than an absolute shambles.
They have hung up on us, been told they to busy to deal with us, been told we in the wrong dept, given another number to be told the same, unanswered letters, and enough is enough.
My mother has had to use her savings to keep going, she is mortgage free, but at 78 should not have to worry about the widows pension, that she is not getting.
Where to next, we know its the right company, but they just being &&&&'s.
Only step I can think of is the ombudsman.

Have you sorted out your mother's state pension?
With regard to a widow's pension, was your father in receipt of a Defined Benefits pension?
Or an annuity?
If an annuity, you are sure that this was set up with a widow's pension?0 -

And... this is very important - how old was your step-father, when did he retire and did they marry before or after he retired?0 -

But you have checked that her state pension is correct?
With regard to your stepfather's pension, you said that you had a letter from the administrator regarding an overpayment.
Where did this letter come from?
If this was an annuity, it is possible that it was set up without a widow's pension.
If it was a defined benefits pension and your mother married your late SF after he had retired it is possible that no widow's pension is payable.
This does not detract from the fact that the administrator of your late SF's pension should be able to explain the precise situation to his executors or his widow.

I suggest that you /your sister/your mother check all your late stepfather's paperwork so that you can come up with some answers.
If your mother has been left in straitened circumstances, she could look into eligibility for Pension Credit.

However, I'm afraid you may need to consider that your mum won't get anything at all depending on the scheme.
For example, if your step-dad was in receipt of an annuity then he may have opted for the higher income from a single life policy (ie, no widow's pension) as he wasn't married when he retired.
In the case of a final salary pension, then it is likely that only his service from 1972 onwards (note: different schemes may use a later date) counts towards a post retirement marriage widow's pension.0
