    Im a first time visitor to the site and wondered if i could get some advise, i have tried to claim the addition active charges back, paid at £15 per month, saying this was mis sold to me and took it our when i opened my account as i thought you had to to get the account, they have advised me as i used the RAC cover on it 2 years after taking it out i cant claim, is this true? Thanks is advance x

    First of all, you have complained and they have rejected your complaint. They are not saying you cannot complain.

    Your reasons for complaining are severely limited if you have used benefits offered. You cannot complain you didnt know about it or that the benefits were unsuitable for you. So, this restricts what you can complain about. You dont state what reasons for complaint you gave so its difficult to offer comment on that side.

    Even if they upheld your complaint they can deduct the cost of the benefit used from the redress and often that leaves nothing to refund anyway.

    Why do you think they are wrong?

  • Thanks again but im still going for it.

    Im obviously going to have to be very careful with the wording and make sure i make them aware the reason i actually moved away from them was the charges and regular bad advice.

    Im sure your correct in what your saying and maybe you dont actually work for a bank but im going to give it a try as the possible but albeit unlikely gains outweigh the price of a few stamps.

    I'll post an update at some point in the future regardless of the outcome but thanks again all

    It's a tough situation. Have you logged it as a miselling complaint with them? If you do, stress that while you have since used the benefits of the account, you only had it because they told you you had to have it. Maybe point out you would only want the charges prior to the RAC claims refunded as since then you have clearly been aware of the features of the account.

    It probably won't work if I'm being honest but if you haven't already complained that's the best I can suggest. If you have complained and they rejected the complaint, take it to the FOS and if they rule against the bank they can force the bank to pay out. It's up to you really though.

    Seems fairly clear that the OP has indeed already complained.

    While this true, FOS won't require the Bank to make a full refund if the OP has used some of the account benefits. If the cost of that outweighs any redress then there might be little or nothing to refund.

    Regardless, the Ombudsman would seem to be the next logical step.

    I've just joined because yesterday I decided 'enough' and sent off emails to payday loan companies and my bank re historical unfair bank charges.

    A quick check of my Noodle credit score and I have seen I took out 49 payday loans in a 4 year period. Yes that's right, 49. I'm a self-employed single parent and I had no way of paying any of them back without borrowing more. And for those who might judge, as much as I hated them they fed my children and kept a roof over our heads.

    None of the payday loan companies have replied yet but a mystery credit under 'goodwill gesture' popped into my bank for £225. I'm guessing this is from my bank. This is a huge amount to me so I am grateful. On the other hand I have paid continual bank charges month after month for years. I never pay less than £60 but before the charges were more strictly regulated it was often £120 a month and this could be because I'd missed a payment by a couple of pounds so incurred a £35 fee.

    Should I stay grateful for the £225 knowing it's much harder to reclaim bank charges? Or do I have a case to recoup more? That isn't intended to sound greedy - but the huge charges were part of the problem that led me to payday loans in the first place and I could write a book about those.

    Only if you are current financial hardship can you ask the bank to review your charges. Financial hardhsip means being in a cycle of charges every month so that paying basic bills [I.E no sky, no mobile phone charges, no netflix etc] puts you in a cycle of debt.
    They may freeze the interest, they may refund some charges, they may stop charging you for a while.
    They are not obliged to refund you any charges because they won a court case in 2009.

    Head over to the debt free wannabe board and look for the thread about complaining about payday loans.

    The banks won the "unfair charges" case at the court in 2009, you cannot complain about them.

    If you are in current hardship you can ask them for help and it's likely that which has triggered the goodwill payment. They are under no obligation to pay you anything more - don't waste time on this.

    Some GOOD NEWS for everyone. :beer:
    In the 80's and 90's I had a Platinum account with Lloyds. I paid £12/month charges. I thought about trying to claim the charges back but a number of people were saying there was a six year time limit to claims.
    Anyway I decided to give it a go at the beginning of this month. I followed the guidelines on the main site and filed my claim through the Resolver service that Martin recommends. To be honest I wasn't holding out much hope as this was nearly 30 years ago. I thought if anything I might get an email saying their records do not go back that far.

    Imagine my surprise then when a cheque for £654 from Lloyds dropped onto the doormat earlier this week, 13 days after I put the claim in! :T:j.
    Don't give up! If you have a legitimate claim go for it!
