What speed limit applies to me?

Hi All,

Wonder if anyone can help. I recently (hired, but that doesn't matter), a Ford Tourneo vehicle, which has 9 seats (8 passenger, 1 driver). I have been sent a Notice of Intended Prosecution for driving at 68mph in a 70mph zone. Does anyone know if the lower speed limit (60) applies to this vehicle? I was under the impression that 8 passenger seats plus a driver = car speed limits?

Thanks! :)

It depends on how it is classified on the V5, I think.

A van which is not a car derived van = 60mph.

    Bus, Coach Minibus = 60mph.

If under 2 tons it maybe classed as a car derived van, but a 9 seat minibus is likely to exceed 2 tons.

Passenger vehicle, not more than 8 passenger seats, unladen weight under 3.05 tonnes. Motorway = 70, Dual Carriageway = 70, Other Road = 60.

Sch.6, Road Traffic Regulation Act 1984.

Things have changed a LOT since 1984 though.

It's a car & subject to car speed limits, a minibus has to have 9-16 passenger seats.

I think that the legal definition of a minibus is a vehicle with 8 to 16 passenger seats.

More than 17 seats is legally a coach/bus.

So the OP's 9-seater Tourneo is legally a minibus not a car.

That means a 50mph speed limit on a single carriageway, 60mph on a dual-carriageway with 70mph only on a motorway.

Plus of course all the complications of driving licence entitlement - when you passed a car test etc.

Loads of people are driving 9-seaters with no idea that they are classed as a minibus with lower speed limits and special licence requirements.

A Tourneo = 8 passenger seats + driver, so the same as a car.

No! 9-16 passenger seats is classed as a minibus anything less than 9 passengers is a car. Anything more than 16 passengers is a bus/coach.

The OPs Tourneo is a car.
