    They refused him before saying he'd got only 6 points (he has a serious heart condition, can't lift things, can't walk far, out of breath easily etc, but because he didn't need an alcoholic drink when he woke up, he was deemed fit to work) :confused:

    Anyway, the people today gave him 23 points! bit of a difference! His condition has got worse since the original rejection as well so they took that into consideration as well :)

    The CAB also said they couldn't help my dad with his appeal because they only take on cases with 7 points or more as they expect to lose any others - although this obviously wasn't true in your case!

    Maybe they need to start disallowing the fraudsters and we might just be on our way to a better system :D

    I am very pleased for you. i also just won my case going from 13 points to 22. I felt so upset going through this, its bad enough have all these medical problems without going through this. That also said because i because I didn't need a morning drink and that because I washed and looked tidy that I was fit for work. let them have a stroke and see how they cope.

    Anyway i am very pleased for you because i no what it does to you.

    I have just been going through all the IB stuff and noticed that they STILL havent awarded him any points for his walking :confused:

    SO

    If they were to go with the 200 yards that we *marked* on the original forms that would be another 7 points taking him to 23 ~ not that I'm gonna question that now, just an observation!!

    Unfortunately thats what this is all about. There must be so many fraudulent claims that from time to time genuine cases will get kicked out which is why the appeal process is so important and should not be feared.

    But I can't help thinking that there is something fundamentally wrong with the original process is so may fraudsters get through and so many real cases are rejected:confused:

    Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)

    You should have your decsion through the post pretty quickly, within about a week as it is just a case of putting a piece of paper in an envelope and sending it off.

    My friend is going through all this. Can you tell me how long it is from you register an appeal to getting a hearing. What is involved? The local council put in an appeal and spent about 2 seconds doing it. Will this impact on getting an appeal or do they all get a hearing.

    It was heard on the 21st and we had the letter on the 23rd.

    We didnt however know when it was going to be heard. I would imagine you're letter will be with you early next week :D

    OH had his medical in Jan and they stopped his IB at the end of Feb.

    We wrote a letter of [STRIKE]disgust[/STRIKE] appeal and they ignored it.

    I had to write again.

    They were very nice and accepted the appeal even though it wasnt on the correct form (is there a form) :rolleyes: :rolleyes:

    The main point of the appeal was the fact that the Dr's report was an administrive shambles and that he had an obvious lack of knowledge of his condition.

    The DWP replied that administration is open to interpretation and that a Dr is a Dr is a Dr and that he was just as qualified as the specialist :rolleyes: :rolleyes:

    Wrote back to say cobblers :p

    Own GP wrote letter of support but consultant ignored the request :mad:

    DWP did not respond again

    You know the rest :p

    Appeals take on average 11 weeks from the time the Social Security and Child Support Appeals Tribunal receives the schedule of evidence (often referred to as the "submission") from the Agency dealing with the case. Your case may be heard quicker than this, but the length of time will vary depending on the particular circumstances of your appeal.

    Everyone that makes an appeal will have the chance to have an appeal hearing as long as it is an appealable decision.
