Parking ticket face down

Hello all

Advice please regarding a private land parking ticket received by post for having my parking ticket face down. I appealed and lost despite providing the parking ticket. Am I likely to win an appeal with Popla? Really feel like this is extortion given I did pay for parking :(

    Get stuck-in to the Newbies Sticky at the top of this forum. Which will properly inform you and show you a range of effective strategies to use with POPLA. Basing any appeal on what happened is unlikely to be effective as PPCs and POPLA really don't care.

    Yes you are likely to win as long as you follow the advice and use the template appeal points from post 3 of the NEWBIES thread.

    Hopefully you didn't reveal the driver's identity when you made your initial appeal as this will give you an extra, and very strong appeal point if the scammers don't know who was driving.

    In any case you will be using Not the Landowner, No standing to bring charges in their own name, and Inadequate Signage to name but a few.

    What happened when you complained to the landowner/retailer where you parked?

    No by repeating the pointless/weak appeal you made (ouch! not good). But you are not the first to do this...the appeal was NEVER going to be won by talking about what happened and showing the ticket. This is not a reasonable industry. Unlike Council PCNs re fluttering ticket appeals, private firms don't just go 'oh alright then'.

    Fruitcake, When I appealed directly One Parking Solution (who issued the PCN) I got this response...

    Dear,


    Thank you for your appeal received on 12/04/2017 regarding the above detailed Parking Charge Notice.

    We have reviewed the case and considered the comments that you have made. This appeal has been considered in conjunction with the evidence gathered by the parking attendant at the time of the event and any relevant mitigating circumstances you have supplied with your appeal.

    We are writing to inform you that your appeal has been unsuccessful. Your vehicle was not parked in accordance with the terms and conditions on site, and you have not provided sufficient evidence to show otherwise.

    At the time of contravention, the pay and display ticket was face down. This means the patrol officer is unable to determine if the pay and display ticket is valid.

    We find this parking charge to be issued correctly and we are therefore unable to cancel the Parking Charge Notice. We must advise you that once the discounted settlement rate (If Applicable) passes it will not be offered again.

    You have now reached the end of our internal appeals procedure. You may now either pay the amount due OR appeal further with POPLA.

    If you still believe that the Parking Charge Notice (PCN) was issued incorrectly, then there is an independent appeals service called POPLA (Parking on Private Land Appeals) and you can submit an appeal to them online entering the ten digit verification code at the top of this page to authenticate your appeal. This code is valid for 28 days from the date your appeal is declined.

    Please note that when using the POPLA service you will no longer be entitled to pay the lower rate of the charge (if applicable) should your appeal be refused by POPLA.

    By law we are also required to inform you that Ombudsman Services provides an alternative dispute resolution service that would be competent to deal with your appeal.

    However, we have not chosen to participate in their alternative dispute resolution service. As such, should you wish to appeal then you must do so to POPLA, as explained above.

    If you are not appealing to POPLA you are now required to make a payment of £60 to reach us by 27/04/2017 or £100 to reach us by 11/05/2017 to avoid this charge being passed on to our debt recovery specialist and/or to avoid court proceedings. Please be advised that any further action may incur additional costs.

    Payments can be made by cheque or postal order made payable to One Parking Solution. Please ensure you write your Parking Charge Notice reference number and vehicle registration clearly on the reverse. It is advised that you do not send cash through the post. Payments can also be made using a debit or credit card by calling the automated payment line on 03330 063 428 or paying online. Please note that for all debit and credit card payments a surcharge of £1.75 will apply to cover the merchant charges.

    Please note that we are unable to enter into any telephone conversations regarding appeals. Our appeals process is full and final and we are unable to issue any further correspondence regarding this matter directly with you.

    It was Vantage Point in Brighton Coupon-mad. PCN sent by One Parking Solution.

    I know that site, in Elder Place. Never parked there though!

    So, I am not sure what you are asking us because you are very clearly at POPLA stage which is covered in post #3 of the NEWBIES thread, with templates to put together. Show us your draft like everyone else does.

    Clue: Your POPLA appeal will NOT talk at all about the ticket being upside down...read the NEWBIES thread post #3.

    You have a PoPLA code, so use it as already advised. Use all the template appeal points available to you from post 3 of the NEWBIES thread. Post your draft appeal here for checking before submit it.

    You haven't told us if you appealed as keeper, or did you give away the driver's identity.
