  • Do remember that all the time this drags on, the more likelihood of your current tenants getting knocks on the door etc - it's not something I'd want to live with, and it IS something that would make me look at moving on elsewhere as soon as any AST was up...

    Something else you may want to address is not having a correct address noted for correspondance on the Land Registry website. It should be an address or addresses that correspondance will reach you on - from memory you can have two physical (so maybe the address of the property and your current residential address) and one electronic.

    To be honest current tennants are partially to blame for not passing on any of the no doubt many increasingly threatening looking letters in my name they must have received! Also they've already had the knock on the door and they've already proved to bailiff they're not me. If the bailiff did go back or swipe any of the tennant's stuff they'd have excellent grounds for complaint for harassment. Anyway, as I understand it, the bailiffs can only charge for visiting once so I doubt they'll bother them again.

    Will look into getting a correspondence address added to land registry.

    That shouldn't get you anywhere other than leaving an outstanding council tax charge - the council should pass any monies to the enforcement agent and it will be offset in turn against the fees as required.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    They don’t have to pass on letters to you. It is your responsibility to let the council know where they can contact you. If I were your tenants your post would be binned.

    Maybe the OP charges a lower rent in exchange for being a forwarding service for mail?! :D

    I wouldn't blame your tenants for chucking mail, In theory I'd be willing to forward mail to the landlord, however I rent through an agent and wouldn't honestly recognise the landlord's name instantly. I do know I get a LOT of mail for ex-tenants one of whom clearly has financial problems. We also had bailiffs chasing council tax but got the council to sort them out. I've never seen any effect from returning mail to sender so don't bother anymore, just chuck it straight in the bin.

    Don't worry there's no way in hell I'd let you rent my house. My tennants are lovely people, have nothing but nice things to say about me and I don't expect them to forward my mail at all. Still, you'd think they'd mention something if they received a succession of official looking letters with, I'd imagine, something like FINAL DEMAND - DO NOT IGNORE written on them...

    Yeh, I'm not blaming them, was all a bit of a !!!! up on my part, would have been nice if they had intervened and made a bad ting good.

    Lovely people who you blamed and planned to ‘interrogate’

    Accidental landlords eh. Blaming their tenants (one n by the way, may help as a ‘landlord’) for not forwarding their mail and wiping their bums for them!

    As advised previously, your payment will be divided along statutory guidelines paying the bayliff there fee first, then what’s left will be deducted from the outstanding council tax bill.

    It’s then likely to escalate to the next stage which will incur another bayliff fee, and you will still be behind with the council tax.

    This will not turn out well for you if you follow this path.
