Taking name off deeds/mortgage

OH and I bought our house together when we were both working. Now I am a stay at home mum with no income. His income covers the mortgage. If we wanted to buy another property could I take my name off the mortgage and deeds of our current house and then buy a new property in my name only. Obviously this would be to avoid second home stamp duty. Could we do this and is it legal?
