Hi all,
So I had to visit an old address because eBay sent a package to the wrong address, and they had a letter for me from Arrow Global.
They said this letter turns up regular and they gave up sending them back because they never stop so they just bin them.
I opened it and they have been charging me more than I have been repaying for an unknown amount of time and the debt is going up.
I do recognize the name off my bank statement but just thought it was something my Mrs had signed up too because it is £10 a month.
What do i do is this legal?
The debt isn't massive and i can just pay it off but i feel like they are royally taking the p***

Hi,
Normally debt purchasers are not allowed to charge interest or fees on debts they have bought, unless the original agreement allows them to do so.
What type of debt is it, do you have a copy of the agreement ?I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. no the debt is from a credit card over 10 years ago. I thought it had been paid off a long time ago.0

Hi Colonjack
If this debt collection agency (DCA) has been adding the charges inline with the terms and conditions of the agreement it will be harder to challenge. You could still try and complain that they have been unreasonable by adding more charges than the monthly payment you make for such a long period of time. Although there may be an argument to say you should have asked for the charges to be frozen, and given them a forwarding address.
If you're not happy with their response you can escalate the matter to the Financial Ombudsman Service (FOS) www.fos.org.uk. You could also consider making a CCA request to see if they are able to provide a copy of the credit agreement. If your complaint is not successful and they can provide a copy of the credit agreement it sounds like it could be in your best interests to pay off the debt to prevent it getting any bigger.

If its been that long, then a good option here is to send a CCA request as advised above, usually the older the debt, the less chance of them still having relevant paperwork.

Thanks guys, am not familiar with the process so will use the template.
If it is deemed unreasonable or unfair what is likely to happen? Will they just close the account and write the debt off.0 -

Unenforceable is the word you are looking for, No, if they cant comply for any reason, or what they send you does not comply, all it means is they won`t be able to use the courts to get there money back, they can still write and ask you to pay, and they can still report on your credit file, they just cant take legal action to recover the money.
In reality, for unenforceable debts, once you tell them your not paying, most disappear quietly away.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. The template says that I will be sending £1. Do I have to do this by cheque or can I just put a pound in the envelope?0

Err the £1 statutory payment should be made by cheque or postal order, never cash.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
