    Yep that will win - MET normally throw in the towel.

    If you want to, there is more you can add to the 'no keeper liability' argument as:

    - the MET Notice to Keeper does not mention a 'period of parking' as specified.

    - the MET Notice to Keeper also will not state the 'unpaid parking charges and describe how those arose'. You might say 'what parking charges, it wasn't a P&D car park?' So what, the wording in Schedule 4 is mandatory - a PPC has to set out and describe the 'unpaid parking charges' (not the PCN charge because that wasn't 'unpaid' as at the day before the PCN was ever issued). Even if they are zero, IMHO.

    - not sure how close to Airport land the McDonalds is, but if it's on site pretty much, you could argue that it is part of a site under statutory control (in the form of the Gatwick Airport byelaws). As such the DVLA has confirmed there can be no keeper liability and POPLA has also confirmed this legal point before...*

    Reasons for the Assessor’s Determination
    It is the Appellant’s case that the parking charge notice was issued incorrectly.
    The Operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking, in fact, were.
    Accordingly I have no option but to allow the appeal.
