Boiler cover problems....

I'm needing some advice....
My partner and her ex husband split around 5 years ago. All the bills came out of her bank account including a boiler cover policy. When they split she cancelled everything as she moved out of the house but accidentally overlooked this direct debit.
A couple of weeks ago we had a knock at our door from the ex husbands new partner with a package that she thought had just been sent to the wrong address. It contained 2 mini fan heaters. When my partner phoned the company to question why, we found out that her ex husband has had several boiler repairs done at their old house under the policy that was overlooked. We had been paying it for x number of years (completely our fault for not noticing) and he was claiming for his boiler repairs through it.
She has asked for transcripts of calls and logs etc but the company are declining these as they say the account was a joint account, but my partner is adamant the account was set up solely in her name, and the mini heaters that came we solely addressed to her making me believe this to be true.
As annoyed as I am that we overlooked the direct debit for so long, I am even more annoyed that the ex has claimed all this knowing full well he wasn't paying for it. I think there may be more to this and believe there to be some sort of fraud.
I just want to know is this worth trying to build a case to take to a small claims court?

I suspect ex would claim he thought the money was coming from his account.
I know this is annoying, but is it worth stirring up ill feelings again after all these years?0 -
Possibly true, I'm just infuriated that he was so brash to do this but I honestly believe he knew he wasn't paying for it. Thanks though....0

This is down to you or your partner for not keeping an eye on your accounts.
How do you not notice a direct debit coming out of a bank account unless you never ever check statements and have enough money that an odd £10-£20 a month going astray isn't noticed.
If you dont check your accounts then you have no idea if you are being defraudedNever under estimate the power of stupid people in large numbers0
