mmile Motormile Finance UK Limited (MMF) Advice Needed

Good evening,

I received an email today from @mmile with the subject header, "Your account is being prepared for Legal Assessment - Act Now" (their caps locks not mine!)

Previously, I had received an email on the 21/02/2017 with the subject header "Intended Action (EXOP)" - I had read on the CAG website similar emails received and took the general advice on the website to ignore the email.

However, having received the second email today I am unsure what to do.

From what I have read about mmile and what the debt may be, they operate as payday loan collectors. I have had two payday loans in my life and one was fully paid and the other has not been paid back. The one that hasn't been paid back was approximately 5 years ago. I accept responsibility to pay it back but I am unsure how to contact mmile, for example, is there a template letter for an appropriate next step, and secondly, should I even make contact with them.

Thanks in advance for any words of wisdom.

    This is an earlier response I made to another poster earlier today :

    Motormile are mostly all mouth and no trousers.

    You should write and demand proof of the debt, you should also inform MM that using the threat of legal action in order to gain payment of the debt without providing any evidence of liability, is a practice frowned upon by the FSA.

    I have sent the Prove It! letter today via Recorded Delivery.

    Yesterday, I was unsure which original creditor assumed that I owed them money, having never heard of Northway before. However, after some Google detective work I can see that they are/were connected with poundstillpayday. Previously, I have had a loan with them but it was paid off in full, over 6 years ago.

    I do not have any evidence that I have paid back this loan and now they are asking for payment via a DCA (mmile). I paid the money back to poundstillpayday directly over the phone, at the time I was naïve and did not ask for a letter confirming the payment as full and final settlement, something which I know to do now.

    Shall I just wait and see what the reply is from the Prove it! letter?

    I received an email in response to my Prove it! letter with the original creditor showing as "Pounds Till Payday - Payday loan" and with the following text:

    We write with regard to the above referenced account number and recent communication.

    Please find attached as requested:

    1. Copy agreement information
    .

    I have read the copy agreement and it is dated 25 March 2009. I am almost certain that I paid this debt back in full years ago but I have no record of this (stupid I know).

    How can I prove that I paid this amount? What should I do next and should I reply to their email or continue to send letters by recorded delivery.

    Thanks in advance for any help.

    How did you pay it?


    You can request bank statements if paid by Bank Transfer or a CPA.

    You are not required to prove anything.

    Inform motormouth that the debt has been paid in full.

    It's then up to them to prove otherwise.

    @Stopit What is a CPA? And, I didn't pay it myself, a relative paid it, I've asked them if they have any record and they are going to the bank tomorrow tp see if there's any information. As far as I remember, it was 7 years ago, it was paid by debit card over the phone.

    @Sourcrates Thanks for your original help with the Prove it! letter. With regards to your advice this time, do I reply to their email or send them a letter? Letter or email, do I simply say, "the debt has been repaid in full" and wait for their response?

    Just checked my Experian credit report using the credit club (beta) and I can't see any reference to this payday loan, can I just send them a statute barred letter? The only other letter I sent them was the Prove it! letter but as I understand it, the Prove it! letter does, by its very nature, not acknowledge the debt.

    I am tempted to tell them that the debt has been repaid in full but isn't it just easier to tell them that it's statute barred? Without the evidence of payment I am tempted to send them the statute barred letter, but will wait for your wisdom on this one.

    Basically as MMF usually deal with PayDay Lenders, they use this CPA to take whatever they feel like. However these payments are usually very clearly marked on your bank statements, If you can show that your account had money in from this PDL, then money out to settle this debt, all is well.


    However, as stated by Sourcrates said, they have to prove you didn't pay it. If they "prove" this by dodgy means, you then prove that you did settle the debt and then you can chase these crooks for harassment.
