Who pays a Licence to Assign

I am on the verge of completion of buying a small flat to let.
When I got the final statement a fee of £300 had been
added for the "licence to assign". The seller's solicitor expected
me to pay this, however my solicitor has now taken this off as
they say the seller should pay it. While the solicitors argue this
out between them, can anyone advise who normally pays this
fee?

    A "licence to assign" is the permission from the freeholder given to your seller allowing him to assign the lease to you.

    I assume you have exchanged, so if it isn't agreed that you will pay this charge then it is for the seller to pay, indeed.

    Agree with jjlandlord above. The document gives permission to the current owner to assign the lease to you so really it's aimed at the current owner.






    Also £300 is a lot of money for a simple standard document. Sounds like someone is trying to make some money somewhere.
