Car immobiliser broken after 5 weeks

Hi, I bought a Ford Escort from a garage about 7/8 weeks ago. The seller, Andy, refused to give me a warranty. After 5 weeks the immobiliser went and the car has been parked up since then. I contacted him and he has said that because there was no warranty he is not liable but as a gesture of good will he would pay for the mechanic if I paid for the part. He also 1st quoted a price of £120 for the part and then retracted and said it is £150. I phoned the Ford garage and they have quoted £128.16! He was going to order the part and get his mechanic to fix it today, but now wont answer my texts. When I quoted SOGA his mate laughed and said Trading Standards don't know what they are taking about, and if I take them to court the judge will laugh and say it is my problem. I don't know what to do. I really need the car ( I didn't buy it as a garden ornament!) and to go through court will take weeks. Help!

buy the part yourself have a autolecy fit it send a copy of the bill to the garage and if he doesnt cough up youll o through the small claims court. send recorded delivery, and then if no reply in 14 day send another final attempt to repay letter, then wait 14 day then if no replay proceed you application to small claims, this is how i would see it, to get me back on the road and get my money back and retain the vehicle.

Try and ask him, nicely, to reconsider. An Escort will be 13 years old, at newest, and I suspect you paid banger money for it and hence no warranty. By all means try to go down the route of threatening him, it will only end in him laughing and putting down the phone.

That's shocking, I can't believe he could be so maverick when guessing the price of a part!

    Sorry, couldn't resist :D
And that my son, is how to waft a towel!
  • Thank you all, the escort is a '98 finesse, and only had 40,000 genuine on the clock, full service history, tiny bit of rust.. lovely car . which we paid £995 for :(. The mechanic must have thought he was coming back as he has left wires hanging out ... If I could get hold of the mechanic maybe he will do it as a private job ..
