Civil Penalty Notice

Hi, I've got a civil penalty notice from car parking partnership and I've appealed via their website about being a resident of the area. However, I have now read 5-10 threads on here saying ignore, ignore and ignore. I now know I should of just ignored but my question is that now I've appealed, should I still ignore letters they are bound to send?

All I said in my appeal is that that is my parking space.

    NO, you've read old threads; ignore is the 2012 advice but in 2013 most regulars recommend you APPEAL. Are you sure they called it a Civil PENALTY??

    It's not a very 'legal' charge (but not 'illegal' as it's just a speculative invoice) and you WILL NOT be paying this.

    Your options are:

    - to challenge it to POPLA with our help (if this was in England or Wales only) when you get the rejection letter from CPP.

    - OR ignore it (a must if in Scotland) and a reasonable option in England/Wales if you don't mind ignoring debt collector letters and doesn't scare easily.

    This is a well-known 'fake PCN issuer' and if you decide to send a challenge make sure it doesn't even tell them anything.

    Please show us your draft challenge and definitely get help at POPLA appeal stage once you get that rejection letter. It would be daft to ignore it now that you will be at the stage where you can win this - and cost them money to fund the POPLA stage!

    Thanks for the reply. Just read the notice again. It doesn't actually mention penalty anywhere. It's just titled "civil park notice".

    In my first appeal I quoted their reason for issuing me with the notice(Parking in a resident's parking space without clearly displaying a valid resident's permit) and said that I am a resident of the housing estate and I have a letter from the council saying my permit is valid until May even though it has a end date of March written on it.

    Since it seems they reject all appeals, do you have an idea of how long before I get a rejection? And which of the two options would you recommend I take when I get rejected?

    You need to sit down and read those links. As you will see from the Parking Cowboys link about 'keeper liability' they have to accept or reject your appeal within 35 days.

    And as I said above 'it would be daft to ignore it now' so please update your thread when you get the rejection letter and tell us whether they actually give you the POPLA code that they should. If they do then that's your chance to get this cancelled at their expense!

    In the meantime read those links as you will need to formulate a draft for POPLA which we can then help you to perfect. Sounds like you have a very strong case anyway but you will see that the links I gave you also have other challenge points to add into your POPLA appeal.

    Hi, just received my rejection from the online appeal back via email.

    "Thank you for your recent correspondence regarding the above Civil Parking Notice (CPN). I have considered the case carefully and have decided to reject your appeal on the following grounds;

    Your vehicle was recorded as parked without displaying a valid permit. This is due to the permit on display having expired. It is the motorists responsibility to display a valid in date permit and is clearly signposted therefore would not warrant us in cancelling the notice.

    I am confident that all signage and the CPN are compliant with all industry standards and to the British Parking Association's code of practice to which we subscribe."

    I've been provided with a POPLA code, how would you suggest I start off? Thanks

    Again, read the links already given to you, that's the basis of your POPLA draft to start with.

    Formulate a draft for POPLA which we can then help you to perfect - no-one can write it from scratch except you really, as you were there and know some of the issues you've identified by now I assume, after reading up about it when you first posted & got the links I provided.

    Sounds like you have a very strong case anyway but you will see that the links I gave you also have other challenge points to add into your POPLA appeal. So just put it together and post your draft here for further advice.

    The links really are self explanatory; not as complicated as they may appear at first glance. And read the BPA Code of Practice (honestly!) to pick out the breaches.

Some of our posters help here with this, but there are more there and it might be quicker.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Yep but pepipoo won't write a POPLA appeal from scratch either - well I wouldn't anyway, no time and lack of the 'inside information' that the OP has. And to be fair, the OP has had a lot of links & info to start to put a draft together even if copied from other people's POPLA appeals. It's pretty easy to write a draft letter when shown examples of them...

    No the decisions are not binding upon you, and its not a fine
