On the 27th of March I completed an online application for a short term payday loan, I was unsucessful but passed straight to the application page for EZE loans. I filled in the application form after reading their terms and conditions which state.....

4.1 A one off joining fee of no more than 74.85 is payable in most cases after you have had an average of 14 days membership and access to the site. If you have not cancelled/terminated your membership with us, you will be automatically charged by a direct charge to the debit/credit card authorised by the member with an ongoing membership fee of 8.89 which is payable monthly until such time as you decide to cancel your membership.

I have only been on there for 9 days, I have not used the site, and, as I no longer need a short term loan was going to cancel the "membership" only to find that today (on day 9) they have taken 67.70 from my account leaving me unable to pay for the family food shop and other bills, after to'ing and froing (there is no contact number so everything is being done by email). Finally they are agreeing to refund the fee but are telling me I have to put it in writing and it will be a further 14 days from recieving that before they will process a refund, I dont feel that this is acceptable. Am I right in thinking that they have broken their own terms and conditions? What else can I do?

They haven't broken their T&C as they charged you less than the maximum fee stated in the T&C. It does specifically state the fee will be taken on average 14 days after you join, that obviously means for some it will be sooner and for others it will be later.

You are fortunate that they have agreed to refund your fee, it sounds like they would be within their rights not to from the clause you have copied.
Its normal that companies like these insist on you requesting your money back in writing.

Thank you for that, looks like it was their way of covering their backs for taking it nearly a week early with sketchy T&C's :/ Will phone the bank back and make sure they aren't permitted to take anything else and get the written request in the post today

I must say you are one of the first to not be shouting Rip off, theives etc at this company as you did clearly understand what you were letting yourself in for.

It does beg a question - why go with a company with "sketchy" T&C's in the first place?

I'm glad you can see your next course of action.

To be honest I didn't realise they were as sketchy as they are, My own fault for not getting them double checked, I read it as you had the standard 14 day cooling off period in which you could cancel and not be liable for the fee if you decided not to proceed. I shall not make that mistake again I guess I've done well to press them into a position where they are agreeing a refund at all! frustrating none the less as I now have to try and secure a wage advance from work to cover my short fall :/

I would still report them to the OFT and the Financial Ombudsman as they are operating on peoples trust and just think of how many people do not realise that their money has been taken or (and that is even worse) that they still pay their 'subscription' in month or years to come.
People who are using their 'so called services' are on the edge and very valuable and therefore very susceptible to scam's like these as they offer nothing you can not get yourself via Google but taking the money from the people that need it most. All they do is give someone who is in need false hope and they have to be stopped.
It's only a 2 minutes call or you can do it via the net but as more complaints they get as sooner they will be out of business. If you don't want to do it for yourself you may be able with this to protect a future victim of this scam.

Ive also been scammed by eze loans. my bank are in the middle of trying to get the 80 quid off them, why they took it ive no idea. i tried ringing the number on their website. lo and behold. its been disconnected. the advisor in the fraud dept at my bank said theyd had loads of phone calls about this company unlawfully taking money off innocent people, and were trying to get them shut down. lets hope so

hmmn.....are we trying to find a legal argument for dodgy loan brokers to keep their fee when they have simply re-worded their t&cs to describe it as a membership fee or some form of subscription?

You have to admire their cunning really. The 14 day clause has been inserted because you are entitled to 14 days cooling off period under the Distance Selling Regulations Act - however if you are unhappy that they haven't delivered on their promise you can get your money back after the 14 day period.

Technically you can claim back any broker fees charged, within the last 2 years.

It's just another scam everyone - avoid like the plague - complain in writing and get your money back asap.

SORRY you are one of meny thats been ripped off there are a few posts on here about this company, i am one od those thats been ripped off i cant get my money back the bank wont get it back because i parted with my debit card details?
however i am going to try again after one of the posts on here suGgested writing to them again
HOWEVER IT SEEMS THEY ARE JUST RIPPING PEOPLE OFF WHO ARE FOR WHAT EVER THE REAON IN NEED OF MONEY
this company IS TAKING ADVATAGE OF THE MOST VANARABLE [OF CAUSE YOU DO YOUR BIT BY NOT READING THE T.C AND PARTING WITH YOUR DETAILS]
unless you have paid by credit card i dont think you will get your refund that easy.
i SUGGEST YOU DO LIKE OTHERS ON HERE AND EMAIL WATCHDOG AND ASK FOR HELP. THE MORE COMPLAINTS THEY RECIVE THEY MAY CONSIDER HELPING PEOPLE.

"From the information you provide, the relevant law that would apply to your dealings with the trader is section 155 of the Consumer Credit Act 1974, a consumer is entitled to a refund (less 5) of the fee paid to a credit broker if for any reason the consumer does not enter into a relevant agreement within six months of an introduction to a source of credit or hire.

The law requires that this refund must be given if you do not accept a loan through the broker within 6 months of paying your fee. Therefore, you would be entitled to a partial refund of the fees you have paid these companies."

And just to add they said i will get refund within 14 days from receiving my letter, well they received it and emailed me saying i will be refunded within 14 days but i'm past that date now so emails away i am with them again.

so don't get hopes up you get your money back within 14 days

to all purposes i think eze-loans have taken our money and ran....
but i think they have set up a new company-which is suspiciously like the ezeloans.net website with the same auto emails aswell....

sounds like same m.o be interesting to see whats registerd with compaies house? [assumimg they have to register]

i know i not got my money back cause i was foolish [like meny] but why should they be allowed to get away with it????

true i was stupid and used my debit card with this website*lesson learnt* , BUT whats wrong is a blatent refusal to refund my money,
of which i have a right?
Now im not giving up on this or this dodgy company with its sketchy t&c's that seem to dodge every angle of the law!!

the company doesnt have a consumer credit licence,doesnt use the office space address provided to send your letters to..doesnt give u a refund when it promises you and doesnt respond to emails?

now surely this constitutes as fraud??
