my mum died in april this year leaving me £15k, i'm a single dad and i look after my 2 children full time now i had to quit my job unfortunatly as my ex partner deserted us a year ago, i recive income support and tax credits
1. i take it i have to declare this £15k when i get the cheque
2. is there anyway round it as my brother has been paying my mortgage for a year now and i owe him that and i owe him £2000 cash, can i pay a credit card debt off of 2.5k will any of this get considerd

    I am deeply sorry for your loss.

    I wouldn't tell you to do anything I wouldn't so I will just be blunt with you and say keep it a secret if you can and don't declare it.

    It will only work against you at the end of the day if anything.

    Ask the executors to pay your brother whatever you owe him first, directly, then send you a cheque ONLY for the remainder.:confused:

    I do think you need to declare it, and also you need to talk to someone about getting help with paying your mortgage as you can' keep going long term in your current situation.

    Best of Luck, tell the truth, it might not work in your favour, but if you get caught hiding money the consequences are worse.

    I will declare what i get as im not into cheating the system as i've paid my taxes for 18 years,
    me and my brother are the executors of the will so could i sign over the £8000 i owe him and get a cheque for the remainder for myself then declare it thanks;)

    I believe (but dont take this is a given) that only savings in excess of £6000 are taken into account when claims are made for benefits/tax credits (it was certainly true for working tax credits which I claimed for a while). So if you pay back your brother and pay off your credit card debt, that may leave you below this amount? Could you get the credit card amount added to the cheque with the money owed to your brother and paid to him direct, so that your cheque is as low as possible?

    my solicitor who is dealing with my mums probate has wrote a cheque out to me for 5k, so there is still another 10k to come, when i get the cheque could i take it to one of those 'cash your cheque in' shops that charge a certain percent, :confused:

    I'm afraid that this would be deliberately committing benefit fraud, for which you can get a criminal record and even a custodial sentence. I wouldn't care to risk that as a lone parent.

    you could get it paid in your brothers name for past loans and mortgage payments . Get a benifits advisor to look into help with your house as a single dad with kids you are entitled to some help with your mortgage and income support

  • Sign the lot over to your brother and get him to keep paying the mortgage until it's all used up.
  • I wouldnt delcare it, the taxman isnt going to find out and your struggling so why shouldnt you take advantage of a few quid, especially as you have been paying taxes for all these yrs.
