Gifts over the Nil Rate Band
Hi, I am Executor for my late Dad's estate. The amount of gifts he gave away over the last 7 years exceeds the Nil Rate Band. The guidance states that IHT has to be paid by the recipient of the gifts over the NRB threshold and not from the Estate. Is there any way the IHT could be paid from the estate?

Grant of Confirmation
Hi, I’m trying to fill in the form for Grant of Confirmation for my dad’s estate (C1). I’m trying to do this on my own without a solicitor. I think I understand the main issues, it should be such a simple situation, but what exactly to put on the form is driving me crazy . Would be grateful if anyone could help.…

Squatters using utilities
Hello, I posted v recently on here about my contentious probate issue. Mum died intestate, brother and I will Inherit. Brother being horrific, believes he is entitled solely to a large piece of land mum left (on separate deeds, owned by her). Caveat entered by both of us on Probate Registry until issues are sorted (there…

Tennants in common, do we need probate?
Apologies if this has already been asked, I feel like I'm going around in circles and don't know where to start! My mum died in January. She left my dad as surviving spouse and I have a sibling. Her will seems to be straight forward and seems to leave everything to my dad. The one area that seems not so straight forward is…

Forever stuck on IHT403
Good afternoon, apologies in advance for the long post. I feel like I have been stuck on IHT403 for a very long time and I cannot for the life of me determine what I need to do. I don't know how to just state a value for 7 years worth of gifts without giving more detail. In context, the gifts are not large at all and are…

What to do about Car - Registered Keeper ?
I'm not sure if this is better here or on the motoring board but hope someone can help. I registered the death on Thursday (delay due to coroner being involved) and am now looking at the Tell Us Once…

Basic IHT question
Hi, new to the forum and just need clarification on something. My Dad passed away and I’ve been helping Mum sort everything out. Dad has an ISA for £75k which Mum doesn’t “need”. She suggested giving it to me as a gift. Her estate would be worth around £750k and with my Dads tax free amounts for personal and property,…

Inheritance Tax Annual Exemption Scenario Question
I was wondering what would happen in the following hypothetical example: Someone is yet to use their £3000 annual exemption for inheritance tax for the current tax year and they have £2000 left over from the exemption for the previous tax year. If they give £2000 away this year, I assume that £2000 uses up the £2000 left…

Unexpected bill from energy company
My husband died last year. This week I received a letter addressed to him from Ovo, an energy supplier we've never used, for a period when we were paying bills with another supplier. The billing period is for about a month (May-June of 2023) and is only a couple of pounds. It appears to be relating to a void property…

Council tax, probate and duty to retain
What is a "duty to retain" on an empty property? It's in reference to when additional council tax premiums are due on empty properties. We are dealing with an empty probate property which I thought had an exemption lasting for 6 months after probate had been granted, but I've just read something on the council website that…

Change of executor address
Can someone please confirm if I need to raise a Codicil to my will if the Executor's address on my will has changed? I guess when they come to apply for probate they will of course complete using their current contact details. Thanks.

Administering an Estate
I am mid way through administering my late cousin’s estate after a 7 month wait for Probate. Her property is sold, creditors paid and I am ready to distribute her bequests & finalise the accounts. Refusing to go to Probate

Probate advice
Am I on the right track? I am an executor for my mum’s will. She died in January 2024 and has left a house worth approx £420,000 and a few small household goods to her children . I don’t think there is inheritance tax to pay (personal allowance of £325,000 and residence nil rate band of £175,000) but I still need to…

Bogus Valuation by the administrator
Hi, I have a problem with an administrator who I think might be dishonest. The administrator was appointed by Probate Registrar a while back. If anyone has advice can you post. Thanks. 1) My dad passed intestate. He left
his 5 kids his house, shares, cash etc. I estimate in total around £750,000 - £850,000. He lived on the…

Possible Negligence by Executor Solicitor
I'll try to do this in bullet points. 1) A friend left me his house in his will. 2) The will appointed a named firm of solicitors as the executors. 3) During December a water supply pipe froze, burst and flooded the house. 4) Extensive damage has been caused. Very extensive. 5) The solicitor has informed me that the…
