Gifts on a Wedding
Gifts of up to £1000 made on a wedding (before the actual wedding) are free of IHT if my understanding is correct, even if one is not related to the person getting married. Doesn't that mean that one can actually give £2000, as £1000 to each of the pair.

Asset Protection Living Trust
I'm looking for some advice on Asset Protection Living Trusts. I've spoken to a representative from Honey Legal about setting this up as our mortgage is now paid off and wanted to make sure we have looked into everything estate planning wise (have a will and LPA). I want to do as much due diligence as possible before…

IHT form 400 asking for copy of POA
Hi all, having returned the original and copies of the POA, I have discovered that the IHT form 400 requires a copy of the POA if you acted using it while the doner was alive. I don't have a copy of the reference either. Has anyone else come across this and how do I get a copy? I think you have to pay if you request one,…

Removing an Executive
Hello, my father passed recently and I have some questions that can hopefully be answered. His unmarried partner who lived with him is the main beneficiary - her bother is executor of his will. Storing a will
I am resident Spain but have made a UK will to cover my UK assets, which just needs to be signed when I come to the UK in June. But I was wondering about the storage of the will. I know most people leave it with the solicitors who wrote it, but I also see that it can be deposited with the HMCTS for a one-off fee, either by…

Free Wiils Month
As part of free wills month, my solicitor has drawnup my will and wants to charge me £350 + vat, because, she says it is not a simple will. I own my own house and want to leave it to my children, but also want my new partner to stay in the house until he passes away. I think this an example of a simple will. Does anybody…

Viewing a Will - Govt Service
Hi, I've used the Probate Service view a will Service and have paid the fee to request a copy of a will. I've so far not received the will and can't find any email or phone contact details to follow this up. The main probate helpline always has a 90min wait time and probably aren't the right people anyway. Does anyone have…

Do I need a 'right to reside' clause?
My husband and I are updating our will. It's fairly simple in that we want our house to go to the surviving spouse first and then to be split equally with our 2 adult children when we both pass. The advisor has recommended we include a 'right to reside' clause but I'm not sure whether this is necessary. Is this a common…

Wondering about legal action for advice to my parents on putting their house into a trust
Hi everyone,I have discussed this in other threads, but my parents were badly advised by their financial adviser and a lawyer to put their home - principle asset - into a lifetime trust. Legacy to grandchildren
Hello, wise ones! Before going ahead with a SIPP drawdown, I would like to check that doing this is the only option. The scenario is that my recently deceased husband left a legacy of £10k to each of our two (now adult) grandchildren. Due to long term care home costs for prior to his passing, the bulk of our cash is in a…

Grant of Probate and Release of bank funds
I opened Executor Accounts at Lloyds Bank shortly after my mother's death. The account, with balances, was blocked pending receipt of the grant of probate. To my surprise, HMRC handled the IHT within 3 Weeks and Probate took only 2 Weeks. I contacted Lloyds Bank and instantly forwarded them the Grant of probate. I was told…
