			<description><![CDATA[Looking some advice on what is the best option at the minute. 
  
I have rather large credit card debt, it's time for me to wake up, smell the coffee and stop the denial. 
  
I've been having the night sweats, lying awake in a panic about out financial situation and now need to get it sorted. 
  
So question is....would I be better to try the credit card 'shuffle' in order to get 0% rates or better to try and get one big loan to clear the cards and pay off over the next lot of years??

I wrote to MBNA (Bank of America) to reclaim my charges at the end of October. 
  
Got home tonight to a letter from them in which they state that they do not accept OFT decision about unfair charges.  MBNA believe that their charges are fair (I don't think so), but as a gesture of good will they will refund some of the charges.   
  
Now I didn't think they had the option to accept the OFT decision.  Surely that's like me saying well, I accept that I owe you so much money but I don't agree to paying interest. 
  
Any advise on how to proceed, oh yes they also want to credit the refund to my credit card account, I don't want them to do that I want the cheque so that I can distribute it equally amongst my other debts.]]></description>

I am in the process of reclaiming PPI, and I have the original statement which confuses me somewhat. 
 
It was a HSBC Loan. For 4000 pounds and it was over 5 years.

I then make monthly payments of #104.64 for 26 months, and then I closed the loan by repaying #3557.76 on the 9 nov 06.<br />

HSBC have wrote to me and say they did mis sell PPi on this loan, but I cannot work out how I repaid #6278, on a 5 year loan I only had for 26 months. I am sure the APR was roughly 14%. Could anyone please explain how the figures work out as I am really confused.<br />

She was told at the start of it not to go Bankrupt as she had disposed of her share in a property less than 5 years ago. The 5 years is now up. She is an OAP on basic state pension and is struggling on the DMP. I think she should now make herself bankrupt. She has no assets and no money in the bank etc. Does she need to do this via the CCCS or does she do it herself? How much will it cost her.  
The other question is if she just stops paying via the DMP will one of the creditors make her bankrupt so costing her nothing? What is the best way please.</description>

I wonder if anyone can help 
I have entered into a DMP with CCCS it appears my debtors have accepted it - however I cannot make my first payment to CCCS until the 1st of Jan and apparently they pay the debtors in or around the 26th of the month.  MBNA have said they will accept the payment restructure but I must pay them by the 18th of the month.  The have said that if payment isnt made they wont accept the restructure,  I do not have the funds to make the required payment for Dec and Jans will be late 
  
Any suggestions / help? 
Should I ask CCCS to contact them and explain the payment schedule? 
  
So near to sorting this out and then this happens and cant contact cccs till monday and no desire to make contact with mbna</description>

I paid off my last debt in full.

Keep fighting! I started this journey somewhat hopelessly (or so it felt), facing £20k in unsecured debt. I was getting divorced (and still am, although that's moving forward now as well), was moving out of the house I had rented and loved for 4 years, and generally just felt like it was all pointless. At 25 years old I was seriously wondering what life was supposed to be like, as I was certain I wasn't living the plan. 
 
A month afterwards I found MSE. All the lovely people posting here - particularly in DFW - offered kind words, encouragement, a slap where necessary, and kept me going. A few months later I found myself, by virtue of my natural tendency to "give back", offering advice to newcomers. The perpetual bug that is MSE well and truly bit.]]></description>

*YOU MUST CONTACT ME ................. WITHIN 24 HOURS TO MAKE FULL PAYMENT.* 
  
*TAKE NOTICE* 
*If you do not contact me, we will return to your property with a suitable vehicle and porters to remove goods to the value of the above debt and associated fees. Note goods and motor vehicles may be removed in your absence.*  
  
I have called the council and questioned the debt as I believed it was paid in full, they have said that it was not and that it is outstanding. I then asked why it has taken so long to send me any correspondence (I had only recieved a letter from them in September which I had questioned and then this) and they said that they had sent a letter in September and then passed on the debt.</description>

Looking for users' experiences of having debts, paying them off and being able to obtain credit at a later date. 
  
I currently have around £15k in debt. Thanks to this website I actually have an end in sight to my debt problem thanks to the Snowball plan - 2 years and 4 months to be precise. 
  
The thing is - I have a default notice on my Egg Loan - I had 2 ask them for help - they allowed me to pay a reduced rate of £130 instead of the original £350. 
  
I am aware that these will remain on my credit file for 6 years and believe me I do not intend to try and obtain any further credit such as credit cards or overdrafts after I have paid everything off however, in 6 years time I will be 28 and I'd like to think I could look to get my own place rather than forking out in rent.]]></description>

The thing is - I have a default notice on my Egg Loan - I had 2 ask them for help - they allowed me to pay a reduced rate of £130 instead of the original £350.<br />

I am aware that these will remain on my credit file for 6 years and believe me I do not intend to try and obtain any further credit such as credit cards or overdrafts after I have paid everything off however, in 6 years time I will be 28 and I'd like to think I could look to get my own place rather than forking out in rent.<br />
 <br />
The question I have really then is will I like to be able to obtain a mortgage after this time once my default notice is marked as 'settled' or 'spent' or whatever the correct term is?<br />

In October, which was my fifth month on the plan, I called and paid them on the 10th. £26 left my current account on the 12th, and then again on the 13th. So I called them up on the 13th, explained that they had taken two payments, and they said they were very sorry, they would refund the 2nd £26 and it would be in my current account within 3-4 working days. However, the complication was, the computer system recognised I had now paid 6 payments, and I had been taken off the payment plan. The agent I spoke to said that if I wanted to rearrange the payment plan for Novembers payment, but that we would have to wait to do so, because if we set up the plan there and then on the 13th October, the payment would be due within 14 days. <br />
<br />
So, on the 5th November, she called me up at home, as promised, and we set up the new payment plan for 1 month. We arranged for £26 to be taken from my bank account on the 20th October - today, as I knew I would have soem money going in today.<br />
<br />
That £26  left my current account last Thursday, the 12th. Unfortunately, there was only £15 in my current account, so the payment was made but took me over my overdraft limit, so there is a £30 charge waiting to be applied to my account. Also, on Friday 13th Nov, there was a £10 Direct Debit which was returned unpaid, for which there is another £30 charge. <br />
<br />
I called them (again) on Monday 16th, and was passed around 8 agents, the last of whom finally agreed to refund me the £26 as it had been taken before it should have been, and said that if I got proof of the Current account charges, took it into a branch, then they would arrange for the charges to be paid for too. <br />
<br />
On Wednesday 18th I took a letter I got from a representative from my bank into a Barclays branch, explained to them the situation, and they said the best they could do was fox a copy of this letter off to Barclaycard and that they should deal with it from there. <br />
<br />
On Thurday 19th, after 6 consecutive days of being over the overdraft limit within the situation being rectified, I was charged another £30. <br />
<br />
Today, I checked my current account, awaiting the £26 refund that they took on the 12th, but it has not been deposited into my account. So I have called Barclaycard again. They said that they could not process the refund on Monday as they did not have my current account details (!!!) and that the refund would be arranged nowm and that I should have it by next Thursday. They also said that as I had authorised a £26 payment to be taken today on the 20th, a second £26 has been taken from my current account this morning !!! <br />
<br />
I did cause a bit of a fuss over the phone today, told the agent that I did not think that it was good enough that I am expacted to wait 2 weeks for them to refund me money that they should not have taken, especially as them taking it had caused so many problems, and that I want the £26 back today. After 47minutes of being on hold, he told me his manager is going to call me back today before 9pm and promptly put the phone down !! <br />
<br />
I am shaking so much I do  not even know how i feel. I don't believe I will get this phone call from a manager today, and am not entirely sure how to deal with it if I do!!<br />
<br />
With the charges due to leave the current account over the next couple of weeks, I can't do anything with the money I had go into the current account today, in case Barclaycard do not sort out refunding them to me in time. so basically, because they took this money early, I basically do not even have a penny and as of yet am not likely to until at least next Thursday, when £26 hopefully goes into my account.<br />
<br />
Any advice from anyone?? Surely they are not allowed to just take money from the debit card whenever they want to??<br />

Everytime i applied for an account it was accepted with £125 credit limit so just kept on doing it and it made xmas and birthdays and even gettin myself clothing so much easier. I could not afford anything of this otherwsise because i was in so much debt with my rent and utility bills as well as a loan shark. I use to sell the stuff i got for free from the catalogue to make money to live 
There was never any credit agreements to sign, it was that simple it became an obsession.  
 
i feel like ending my life as i cant tell anyone, i live alone and it was so stupid of me to get out of control.

I went bankrupt in january 2009 but didnt include all of this fraud items into my bankruptcy and have been on the straight and narrow since. I have never signed any credit agreements for this stuff, but it is still fraud.<br />

what happens now as the company have just found out and the company are looking for restitution under the fraud act 2006<br />
<br />
They say there is 10 grand of debt but 4 grand of it is fraud (other peoples addresses)<br />
<br />
what does this mean?<br />

am i going to jail?<br />

My partners mum has very kindly offered to give lend me a lump sum so that I can offer my creditors a full and final payment and pay off partners mum in a year.  
  
I find reading through all these threads really comforting to know that I am not the only one in debt thanks to loans and high interest credit cards!I have looked on CCCS website for an example letter to send to the creditors which is helpful but I wonder if I should / should not include certain info and I wondered if anyone has any advice or experience with having done this?

<li>Ask the bank to stop me withdrawing funds from the account - can they do this?</li>
<li>In all seriousness...how long will it take to be paid off...due to overdraft fees etc?!?!?!?</li>
</ul>I just want this millstone gone and can't really think of any more options.<br />

I am a full time student and I do not work so I barely even have enough for myself.

so we went into the bank to ask for help and they was sooo happy we had come in at a good stage. which they meant before ceditors go after us. so we asked for a loan to clear the debts inot one payment. and also to give us some spare cash for the kids at xmas. but after 1 hour of discussing this and filling in details the system declined us for a load. so we both walked out in tears as we now have a load of debt that cant keep the payments on and our bank wont help us. the mortgage we have with Nationwide cant be deferred or use a payment holiday. we also cant remortgage as my girlfriend is starting her own buisness up after being made redundant 6 months ago.<br />

so where do we go from here????????? no spare money, banks wont help and the credit fast running out on the cards we have.<br />
 <br />
the girlfriend is doing some avon but TBH this is not helping.<br />

When I first opened the letter, I was a bit aprehensive but I must admit I had to read the letter twice.   
  
I'd won :j.  They admitted that at the time of taking out my loan with Cahoot I didn't have all the necessary info to make an informed decision, no arguments, nothing, held their hands up and said that the evidence they had on file backed up my claim.   And they are paying back all the installments since the loan was taken out in 2005 plus 8% interest.:T]]></description>

Last year my father purchased a dongle from Orange to give him internet access via his laptop. Whilst purchasing he explained that he would be out of the country between December and February and was informed that as long as he didn't download any attachments he wouldn't be in danger of any excessive charges. So off they went and he avoided downloading anything, back at home the first bill arrived and after asking my sister (who was house-sitting) to open the bill he was staggered to hear a sum of £1,522.31 had been charged, he rung Orange and re-inforced the information given to him by them which was that the costs would be relatively minimal -  the longest time he spent on the internet during that time was 25 minutes. Additionally, he was given no written information on costs of usage and calls (which I know is misguided, but his use was nowhere near excessive) and then infomed them that he wouldn't be paying that amount to which he was threatened with disconnection of service. Which happened 2 weeks after that call. 
  
This was followed by the usual red letters, to which my father wrote a letter explaining the above which was met with a swift rejection. This was followed by letters from Northern Debt Recovery, as my parents explained to them that the sum of £1622.24 was difficult for them to pay, so this was then passed to NCO who my mother set up a £75 a month system which she was informed wasn't able to pay by DD so it was a matter of her calling every month with card details, months later when she queired the "difficulty" of paying by DD they insisted they couldn't do it. 
  
Then today she received a letter from ScotCall Debt Collecting Services asking for £1875.34, followed minutes ago by a very stern and distressing call from an impotent, jumped-up little tossrag asking why she had to consult my father before an arrangement of £100 could be put in place. 
  
If anybody could give any further guidance, myself and my parents would be most grateful. Can she pay the £1 a month until her and my father are in a position to pay more?]]></description>
			<content:encoded><![CDATA[<div>Apologies if this is in the wrong section, but I'm asking on behalf of my very concerned parents.<br />

Last year my father purchased a dongle from Orange to give him internet access via his laptop. Whilst purchasing he explained that he would be out of the country between December and February and was informed that as long as he didn't download any attachments he wouldn't be in danger of any excessive charges. So off they went and he avoided downloading anything, back at home the first bill arrived and after asking my sister (who was house-sitting) to open the bill he was staggered to hear a sum of £1,522.31 had been charged, he rung Orange and re-inforced the information given to him by them which was that the costs would be relatively minimal -  the longest time he spent on the internet during that time was 25 minutes. Additionally, he was given no written information on costs of usage and calls (which I know is misguided, but his use was nowhere near excessive) and then infomed them that he wouldn't be paying that amount to which he was threatened with disconnection of service. Which happened 2 weeks after that call.<br />
 <br />
This was followed by the usual red letters, to which my father wrote a letter explaining the above which was met with a swift rejection. This was followed by letters from Northern Debt Recovery, as my parents explained to them that the sum of £1622.24 was difficult for them to pay, so this was then passed to NCO who my mother set up a £75 a month system which she was informed wasn't able to pay by DD so it was a matter of her calling every month with card details, months later when she queired the &quot;difficulty&quot; of paying by DD they insisted they couldn't do it.<br />
 <br />
Then today she received a letter from ScotCall Debt Collecting Services asking for £1875.34, followed minutes ago by a very stern and distressing call from an impotent, jumped-up little tossrag asking why she had to consult my father before an arrangement of £100 could be put in place.<br />
 <br />
If anybody could give any further guidance, myself and my parents would be most grateful. Can she pay the £1 a month until her and my father are in a position to pay more?<br />

Grattan have driven me mad for months now. I have always paid (on time) via their website. Now, they have a new system where they split your account (depending on week terms) and I was given two accounts a few months ago. 
  
I went on the internet, it still asked a minimum payment so paid it. Next I get a letter (and charge) sayin one of my accounts was not paid. They had put the whole payment against one account. Had to phone and ask them to split it as required. So now I can't pay via the website as there is no option to make seperate payments to the seperate accounts or statement saying how much where. 
  
Okay, I calm down and they say I should only pay by phone in the future. Okay I'll do that. 
  
Phone up using Quickserv, nice and easy, pay the minimum off one account, select, pay the minimum off the other, press finish, phone done, forget about it till next time.]]></description>

I go loopy, get a bank statement no monies have one out but I did the quickserv as instructed (my mother was even stood by me when I did!). I've been and checked my phone bill - sure enough there is the phonecall logged. <br />

There response - oh well, it didn't work for some reason. really, really, you think?! Now they say it's best just to phone the operator to pay. So why the hell have the internet web payment site and quickserv.<br />
 <br />
The minimum payment on the website and the statements don't agree.<br />
 <br />
Basically, I do not have any love for Grattan at the moment an usually I'm such a caring person :A:rotfl:</div>

			<description><![CDATA[I am just hoping someone can give me some advice on how to get my wife to have the lightblub moment! – so sorry if I ramble on a bit as the situation I find myself in seem to be all inter connected with one thing compounding another 
 
Basics of my situation 
Me and my wife have been married for about 3 years, she has 2 children (both teenagers) from a previous marriage and we have one baby between us about 1 1/2  
she is a SAHM and I work full time I have done a SOA and we are currently at 'break even point' where the outgoings are matching what we bring in, with a very very small surplus (£20) 
 
now I have cut back on a lot of things that I can control on my own like utilities and I do all of cooking myself and cant see of any way I can make any more cuts myself without my wife’s help. 
 
Now this is the problem, I am ALWAYS the one who says no to getting things, going out, getting in some ‘treat food’ and generally spending on things we don’t NEED etc this as you can guess has been worked out by my step kids]]></description>

<font color="black"><font face="Verdana">This then throws out the budget as we end up with either no extra money left for rewards, or any extra money left to pay of some of the debts if they have not done anything for the money </font></font><br />

<font color="black"><font face="Verdana">it also gets compounded by the fact that because the kids are not doing anything around the house to help, and why should they when they can get spending money anyway? the house is always a bit messy due to school books being left in the lounge shoes in the hall etc which then means the wife has a f**k it moment where she then goes out and buys something to make her feel better because ‘she is the one who has to live in it 24 hours a day’</font></font><br />

<font color="black"><font face="Verdana">these ‘f**k it’ moments usually then end up putting back the months ‘savings’ we have made on the debts so in the long run it doesn’t seem like I am making any headway on the debts as, as soon as I pay off £50 from the ‘balance transfer’ credit card, the wife goes out and spends £50 on the ‘purchases’ credit card </font></font><br />
<br />
<font face="Times New Roman"><font size="3">so can anyone think of a way I can approach the subject without being the ‘nagging husband who wants to control everything in the house’, or the ‘evil step dad who wont let them have anything they want’</font></font><br />

<font face="Times New Roman"><font size="3">how can I ‘force’ a lightblub moment on my wife so that she realises that the only thing I want is to get rid of the debt so we can actually spend the repayment money on ourselves </font></font><br />

			<description>i have got myself into a right mess.  over the last 3 years i have had 2 children, income has gone down so got behind in payments on my catalogues and credit card. we moved house 9 months ago, i didnt change my address with these companies and stopped paying as we could only really afford to live. i didnt tell my husband and he thinks these things are nearly paid off - he will leave if he finds out. 
now the companies have caught up with me with demands and threats of doorstep collection. 
i dont have a printer so will have to handwrite all letters - will this be ok? i will also email copies of the letters to the email address provided. 
i was thinking of sending cca requests especially as the catalogue accounts are about 6 years old and have moved 2 in that time.  
just wanted some advice on what to do really. we have a joint loan and pay for a car jointly which are both up to date and have a joint bank account which is fine, it is just my 3 personal debts that have spiralled out of control.</description>

			<description><![CDATA[Back in September I CCA'd Outstanding services who did not reply. I sent them the 12+2 letter. I then started to recieve letters and phone calls from Intrum Justitia re directing me to Nat west for the CCA. 			<description><![CDATA[My wife just got a letter from Roxburghe saying she owed money to a water company from 2002. 
 
She called Roxburghe and they gave her details of the debt.  She can prove she isnt liable since it was after she had moved out of a rented accommodation. 
 
She was pressurised into paying £60 in order to "suspend and further action" whilst she obtained proof she isnt liable and got it off to Roxburghe. 
 
I know this isn't how the process should work, but she felt the Roxburghe person was menacing and threatening.  She realised afterwards that she shouldn't have paid since she isn't liable anyway. 
 
I tried to dispute the transaction but at this stage the credit card company wont do anything (except for the following circumstance: 1) Roxburghe dont provide the service that the payment was for.....i.e - they don't suspend action as promised 2) they take more money from the credit card which, of course, wont be authorised by the card holder.]]></description>

I am concerned that <br />

1) by making the payment she has in some way admitted liability even though she isnt liable.<br />
2) they will take more money off the card<br />
3) they wont refund the £60<br />
<br />
She is going to obtain proof that the debt isnt hers and send it off.  and then we will see where we end up.<br />
<br />
Has anyone got any advice?!!!<br />
