Original Poster, please explain where your link is meant to go to. It seems just to go to Google. you could very usefully say what company is involved, and why they are offering free phones.

It just looks a bit suspicious.

From O2: "We regret to inform you that the items you have ordered from us are currently
out of stock although we will make every effort to ensure that they will be
delivered to you as soon as possible."

But I also got this from them "We're happy to tell you that your O2 order has been passed to our warehouse for dispatch. This should be on its way to you very soon. "

Wonder which is right? The "out of stock one seems to have been sent an hour before the "on its way" one.

have stopped breath holding now anyway after reading some of the other threads :)

ISSUE: The O2 Services team have advised that a known error on the O2 shop which allows customers to fraudulently obtain free handsets has been added to various websites. It has been identified there is currently over 12,000 free handset orders in backlog as a result of this issue.

IMPACT: Splash pages have been applied to the Consumer shop to prevent any further fraudulent activity. External Customers attempting to place orders with O2 for new handsets and connections will not be able to at present. This change will also be implemented onto the Telesales shop. Once the change begins the Telesales shop will also be off line.

Upgrade and Agent Shop are not impacted by this issue

UPDATE (15:30 27/01/07): The O2 Services Team had a change scheduled for Monday night which as had to be brought foward.(CCR 3176578). This change has been through the test environment and will resolve the underlying issue.

No offence, but calling them to attempt confirmation is a tad daft. This blag has been going on for at least a week, I know a few people whose phones have been delivered.
I doubt that it could stand up in court as fraud as the way it worked could have been a genuine attempt at ordering. Obviously none of them were though. Fairplay to O2 for honoring orders, quite rare for companies to give the benefit of the doubt in such a blatant case.

They probably wont send the phones, apparently, 12,000+ orders have been logged, so they will stand to lose alot. I also got the confirmation, follwed by the out of stock messege. I reckon that they have genuinely run out of stock, but have sent out phones to people ordered the phones, when this loophole was first discovered.

27-01-2007, 10:41 PM
To be honest i think they will send out the phones , the phones cost a company like this next to nothing proberly no mor than £20 per phone ... if they send out 12,000 phones and 70% of them phones used on o2 they will make a lot more than thier money back via peopl buying credit..

At the end of the day are they not legally bound to send you the phone?

Their own T&C's state that the order is not accepted until they send you a confirmation email...which in many many cases they have done.

So therefore they must be under some obligation to provide the phone.

You know that they are supposedly upgrading the site etc...Well when I bought a phone for my daughter from them back in the beginning of December I got the same message.
I couldn't view my bill or track the phone I kept getting the message that the page wasn't available and you have to phone the 0870 number to speak to customer care.
I didn't get any emails from them back then either and was worried that my order didn't go through. I almost ordered a second but on the Tuesday as promised the phone arrived. It took a couple of weeks for the payment to be debited from my card too.

I think they purposely leave that message to make more money by making you phone up.

I have received an email thanking me for my order and has been sent to the warehouse for despatch. However, after clicking on ORDER LINE STATUS,(FOUND AT THE BOTTOM RIGHT CORNER of your order) all the lines are blank except for the following.

o2 online returns card - DEPROVISING FAILED
new o2 online prepay welcome letter - DEPROVISING FAILED
2.5G prepay simcard talk anytime - DEPROVISING FAILED

I'm not holding my breath.

Well I've just got the out of stock e mail, so I stuck my neck out and phoned them on 0161 7055000 and got passed through to hardware orders.

I gave my order number and was told that it was despatched today via DHL for delivery!

I asked how the out of stock e mail came to me and they repeated what they told me and mentioned that the out of stock e mail may have been sent when they ran out of stock, but they may have got more stock and hence despatched mine.

We'll see......

Hmmm, if it turns up, it turns up, if it doesn't, it doesn't and I've lost nothing - but if anyone was being finicky, as far as I see it, according to their T&C's, by sending the confirmation email they HAVE ACCEPTED MY OFFER OF £0 FOR THE GOODS AND SERVICES REQUESTED

Now, as a semi-attentive contract law student, I think the fact that you have paid £0 for the phone leads to a contract not actually being formed. To have a valid contract, one requires an offer and acceptance, as well as some form of consideration (ie. payment). So I reckon there isn't much legal basis through the T&C.

Further to my last post today came and went but the phone didn't.

I phoned this morning to try to get a consignment no and they gave me the wrong no.

I phoned this evening to expadite it and was told that the phone was originally out of stock. When I asked how I came to receive the e mail saying that it was dispached to the shipping dept etc.... I was told that that e mail was sent out automatically. So much for O2s accuracy of information ;)

The gent I spoke to this evening checked to see if the phone was in stock, which it was and said he has re ordered it for me and I should receive it in a few days.

We'll see....

MOBILE phone giant O2 has lost £500,000 after an internet blunder forced them to give away more than 3,000 expensive handsets. The short straw is, there is nothing in that link AT ALL that says they are going to honour the deal. The most we have is an email from them stating that the glitch means they have cancelled the order. wether it is right or wrong is irrelevant to the fact that they are not going to honour it.

I will give it a try myself, but I wont hold my breath, neither will the 40-50 other freinds and family I personally know, whom also didnt get one. It was worth a shot, nobody seriously expects to get nothing for nothing, we all knew it was a glitch, so it was always going to be 50-50 if you were to get one or not. But lets see exactly how many MSE'rs who applied, actually get one. If your gonna fight it, Good luck!
