Says pay as you go so should be fine and you don't have to supply any payment details so the worst that can happen is the cancel the order or ask you if you want to proceed at the correct price

I managed to do it too-must be a catch surely but I guess there will be the option of sending it back (unopened) if there is anything. Plus it would have asked for our bank details surely if it wanted anything?

Couldn't see how you could change from the default phone but will be pleased to get something for nothing so won't complain. :T

It seems to be the combination of sim cards you pick that determines which phone. I've order the LG for myself (picked "talk anytime" for both sims) & an L6 for my hubby (think I picked "talk offpeak" for both) ... whilst I figured out the combination for Ice it came up saying my order had been declined.

Tried for L6 with talk off peak twice and got one off charge of £49.99, then tried talk off peak then talk any time (again L6) but £9.99 one off charge. Can't seem to get L6 without some sort of charge.

OK so I 'ordered' a LG L343 phone, didn't ask for CC details, chose delivery date, and got confirmation e-mail with order number etc Will wait and see, I bet there's some heavy restriction in the T&T's or esxpensive tarrif that the 'phone is is locked onto.....any one remember the '40% off voucher' frenzy from Threshers over Xmas?

Call me cynical & greedy (coz I did order one)....all will be revealed

OK, if I've got this right, this is what it might be:

have just had a quick rummage around the web seems that O2 had high hopes when LG phone was launched (last year) and so this offer (if it is real) may be a push to encourage web access via the phone, coz it didn't take off as well as they may've hoped originally...... Or.... someone at 02 has made a big mistake and will be clutching a P45 by the end of next week!....hope not

Oh yeah, all of you will receive the following:

1. Thank you for your O2 order – email content (order number and details)
2. Important news about your O2 order - email content (passed to our warehouse for dispatch)
3. Your O2 Order Confirmation - email content (We regret to inform you that the items you have ordered from us are currently out of stock)
4. Phone call from O2

That's the point, the link isn't from O2 it's a google cache. In other words it's an 'old' O2 page no longer in use. The correct O2 page is this one:

Um, I'm a bit vary of this, the monthly top-up charge is £10, but would anything happen if I ordered this and then did nothing - aka sold the phone on eBay? also, on the basket it does say next to Monthly Charge "one off charge". what's that?

Seems a bit dodgy to give a free phone and then expect nothing in return - aka not free.

Well you are manipulating the website using a third party one (Google cache), in order to achieve gain.

Could be seen as an offence under the Computer Misuse Act if you were to recieve the goods, unauthorised access to a server whilst circumventing protection measures put in place to prevent you from doing this.

(If you try it on the non cached version you get an error)

Google cache is in the public domain, not that I have a clue how to make use of it, it's down to Google for making it available if O2 want to point the finger.

It can hardly be seen as misuse/hacking either because it has been posted on numerous public forums and has been made available to thousands of people.

This is like talking to a brick wall. None of you will get ANY phone by using this exploit.

That means absolutely nothing. I could show you public forums that give out 'hacked' credit card numbers, doesn’t make it legal.

As Kilty pointed out, this is a 'soft hack' of the O2 site. Before you start crying or trying to justify this, I’m only passing on information that O2 spoke to me about.

Hi when i click on 2nd option talk anytime 3 it puts in basket- then click back it then tells me that there is nothing in my basket. cannot find a 5th option just a list ofpay as you go phones

I think all that will happen is o2 will contact you saying you that they have made a muck up on the site and they reserve the rights to cancel any product mispriced on the website and will phone you and ask you if you would like the product on the correct price before cancelling it in some cases.

If you have ordered and it says you will receive your phone, don't get your hopes up!

how can you track the order number other than through the o2 website?

That's a silly thing to say :rotfl: , using 'hacked' credit card numbers is taking money without someone's knowledge and obviously illegal, whereas O2 are in complete control of their own stock and can decide themselves as to whether or not they actually send anybody a free phone or not.

We don't see the phones but no need to panic.

I ordered mine just under an hour ago and got an email saying it was accepted etc and would be delivered Tuesday...

And they cant send a bill with it because anyone could of sent it to anyones address...

And the o2 site is down :eek:

I think they are fixing it....

ISSUE: The O2 Services team have advised that a known error on the O2 shop which allows customers to fraudulently obtain free handsets has been added to various websites. It has been identified there is currently over 12,000 free handset orders in backlog as a result of this issue.

IMPACT: Splash pages have been applied to the Consumer shop to prevent any further fraudulent activity. External Customers attempting to place orders with O2 for new handsets and connections will not be able to at present. This change will also be implemented onto the Telesales shop. Once the change begins the Telesales shop will also be off line.

Upgrade and Agent Shop are not impacted by this issue

UPDATE (15:30 27/01/07): The O2 Services Team had a change scheduled for Monday night which as had to be brought foward.(CCR 3176578). This change has been through the test environment and will resolve the underlying issue.

RESOLUTION TIMESCALES: TBC.

How is it fraud if it's their own systems allowing you to get through the checkout, surely it's just a flaw in their system and not fraud on anyone that has ordered as people who have placed an order have done so as a miss-price and most people know they won't receive anything anyway

thats true, they cant say its fraud if its a missprint!! its not like we have hacked their system and changed the prices!

I've just contacted O2 Customer Services about these phone. I've been told that all orders up until 25th will be honoured and after that will either be asked to pay or be cancelled.

I'll hang on to our old phones.

They say there was a glitch but it's now fixed.

Don't see the point of phoning up to see if your gonna receive a free phone as most people who applied will have known you would not receive anything as O2 are not going to give a phone for free but it was worth a try in completing the checkout and it's just the same when Amazon listed the stargate boxsets as by you order on the off chance the you receive something and if you don't then it's no big deal

I received a phone on Thursday. It was delivered by DHL. I could track the dispatch etc from the DHL site. I could track the progress of my order from the official O2 site, under my login.

My friend received an email stating her phone was out of stock - she phoned customer services, spoke to an operator who substituted the phone with another - it arrived on Friday.

I don't subscribe to this being a scam - I'm puzzled, but then again, with all the weird and wonderful offers phone companies throw at people (free Xbox 360, mini moto bikes, PC's etc) perhaps this is just a way of virally driving customers to their site, obtaining details and then offering other deals for those unlucky enough not to get the freebie?

I'm keeping my phone but at the first sign of any nonsense they can have it back.

I had this problem, and until I received an email from O2 informing me that the phone was now with the couriers the option never appeared in my O2 account.

Once it was with DHL it also showed on my O2 account, so perhaps it is only confirmed as ordered once it is with the couriers.

I have to add that lots of my friends and work colleagues have also received the same emails as a lot of people here telling them the phone is out of stock, so I must have been lucky.

One strange thing is that each day they seem to offer different phones, depending on how you click the appropriate tariffs. My friend ordered her phone in the morning the day after me and got a different phone, but her work friends found the offer was gone by about mid day. The following day the offer was back up and running, again with different products, which makes me thing this is somehow part of a cunning ad campaign by O2 to drive traffic to them?

Ordered one of these Motorola Z3 RIZR's and got the 2 emails...1 thanking me for the order and 1 saying it had been sent to the warehouse for dispatch.
Then i got an email to say they were out of stock.

Having checked O2's T&C's I found this:
We shall not be obliged to accept your order. If we do, your order will be accepted by us by means of an email confirming the order. Confirmation of orders will be sent to the email address supplied by you when the order was placed.

A contract for the products and/or services requested by you shall only be formed once our confirmation message has been successfully sent to the address of your electronic mailbox or your internet access provider?s server.

My question is does either of the 2 emails i received constitute "confirmation" and if so, how do i go about ensuring O2 provide the phone?

I am convinced that they are stalling with the "out of stock" message in the hope that no-one chases them for the phones!

Has anyone phoned O2 to check?

Was it from a shared computer like an internet cafe? I think if it was that then i would put it down to the previous person not logging out etc.

However if it wasn't that then I would inform boots, i've yet to make a purchase with boots.com, but if it would have been possible for you to buy things via that persons account then there are problems, and they should be brought to boots attention.

Nope not yet, but i emailed them to ask when it would be coming into stock and they said as soon as it does they will send it... ordered one for oh as well and emailed about his and they said i can either cancel or wait for it to come back into stock.. so on both counts it sounds like me and oh will get them but just not sure when :T

O2 are legally obliged to send you the phone.

Read their T&C's.

Once they send the confirmation email they have accepted your order i.e. they have formed a contract with for the supply of the phone.

The fact that a "system error" meant an incorrect price was charged for the product is largely irrelevant. They had the option of not accepting your order. They chose to accept the order ergo they are now obliged to supply the phone.

Difficult... is the phone still on the website for sale? I ordered the Ice which is still there.. so if they say no longer stock then I will go back to them. Check out if still there and if so email them.

I thought that once they sent conformation it became a legally binding contract? They have to provides the goods or be breaking the law. I'm not 100% though anybody know?

Cannot remember their T&C's but they will probably just say the email confirmation is an automated one

Cannot see many people complaining about this to O2 as it has cost no-one anything to apply for an offer that most of us thought their was no chance of receiving

you need to log into your account , select "view my bill" , and i think its the 3rd list along , track my order. click on that , and then your order numebr , and it will show the progress of your order.

That is their Terms & Conditions regarding ordering items from the Shop.
Clearly, when you submitted the order you actually made an offer for the phone, which they could refuse or accept. Also, it says that if they accept your order, they will send you a confirmation email.

So, if you got a confirmation email, they have accepted your offer of £0.00 and now entered into a contract to supply the phone.

Don't give up, keep fighting them and they have to supply the phone. Or be sued for breach of contract, plus the adverse publicity.

The fact that their system is not robust enough to cater for this sort of "error" is not the customer's problem....after all, you are only submitting an offer to purchase, which O2 can accept or decline.

Right....just had long phone conversation with some drone from O2.

Basically, they have been briefed (that is call centre staff) that O2's legal team have looked at the position and decided that they are not going to honour the contracts "because the T & C's cover them".

So i asked where in the T&C's they are referring to and she say "in the payment section it says until we take payment the contract isn't made"....A BLATANT LIE!!!!

When i challenged her over this, quoting the T&C's word for word from the website, she went all quiet.

The upshot is that i got her to admit that she had no idea what part of the T&C's allow them to do this, and that they had only been told to refuse to honour the orders because the legal team said so. She couldn't even give me a name in the legal team to speak to!! She did give me the name of a manager supposedly dealing with the matter at a higher level.

Next stop...letter to this manager to see if he knows where in the T&C's it allows them to back out of the contract!!

i got my phones! one of them arrived no problem , and the other they sent teh email saying they would cancel it.

I rang straight away and informed that i WOULD be taking legal action with my solicitors , as the payment agreed was ZERO! once they send the email confirming acceptance of the order , they agree that the price to be paid is the price stated , £0.00 , THUS they have a legal requirement to send the phone! needless to say , the phone arrived!

i just had phone call from 02 saying they are not sending phone as on the website there was a technical glitch and its in there t&cs that no one will get a phone or has recieved them i mentioned there t &c they said they are under no obligation ect ect so what can i do now as i told her i will be taking in further and they ahve not had the lg phone ioin stock for 4 months

Might be pointless - but at least they can't say the phone doesn't exist in O2!

Am waiting for my callback from 'another department' after phoning PAYG customer services telling them that I had an order confirmation followed up by email to say sytem glitch blah blah blah. Cost me £3.50 for an 8 minute call - so I figure a few of those and they'll probably throw the phone in for free anyway!!!

politely remind them that the end price , (which you should of received an email advising you about your order showing this) said total to pay £0.00 . Thus they had acepted your order , and entered into a legaly binding agreement.

Remind them that there terms and conditions state that when they send confirmation email to you , the legally binding contract begins.

Thanks for that. I didn't order the top of the range one, it was the LG one but I won't hold my breath. It will be nice if I get it as my other half has a dinosaur of a phone so I shall give it to him.

I would have thought so but you never know.

I suppose it is time to sit back for a while and wait to see if one arrives then think about emailing them.

How long are other people waiting before they contact o2 or are the majority of you just assuming you won't be getting the phone?

I'm sorry that you're unhappy with our previous responses. I can only reiterate what my colleagues have told you previously that we will not be sending you a free phone. If you remain unhappy with how your complaint has been dealt with please contact our complaint review team in writing at the address below: Complaint Review Service PO Box 116 Leeds LS11 5DS Alternatively, if you would like to supply us with a daytime telephone number I can arrange for our support team to contact you to discuss this matter further.

Now I've escalated this to a complaint and have also posed as a customer wanting to cancel my pay-monthly contract - it was met with an emphatic NO. So why should I treat them any differently? Their terms and conditions do not allow for any technical glitches as they shouldn't confirm order of the handset.

I too have received this email and also replied advising that I want to cancel all my contracts with them as soon as feasably possible.

What part of contract law did you refer to to make them change their mind. How did you word your letter/email?

She is also dislexic, so it is easier to ask a question for a simple quick answer, but eople like you just have have demonstrated how easy it is to jump the gun and shoot people with it! Just tried to follow the instructions and got one of the following options. if I don't select a phone, I get a message stating that I have already selected that package.
If I do select a phone, it tries to charge me for both items.
What am I doing wrong, or have they closed the loophole?
