Hubby and I had a car in his name, but we bought a new one on 28/6/06
I sent off the tax disc on 29/6/06 for a refund and (i believe) ticked a box on the form to say why i was asking for a refund (the car was taken off the road and was going to be scrapped)
A couple of weeks later I received my refund cheque from DVLA and all was fine...
Until today. Hubby has had a letter from DVLA telling him to pay up £40 as the car wasn't taxed after 29/6/06 or registered as SORN.
I think it may be because I sent the form off in my name, but the car is registered in his name.
The other problem is I have now found the log book for that vehicle. It didn't occur to me to send off the log book (even now I still can't see where I'm supposed to fill it in to declare SORN) as I presumed the form for the refund of the tax disc covered it.

Please can anyone clarify what i need to do next.

Phone the DVLA and explain to them - they might be able to tell you whats what.

There is a campaigne on tv stating that you will be liable if the car is not taxed, but im sure if you cashed in road tax on the said date they will understand that the car is not to be used .If the car is sitting in a public place it has to be Taxed whether it is being used or not so you will have to prove its sitting in a garage or driveway to your house untill such time its getting scrapped you could always tell them if they check they will see that now your running a new car and you needed the money in cashing in tax for the new one to make ends meet.Good Luck

Thanks. The car has been on the private land behind our house since the day I applied for a refund, we just never got round to getting it taken away! I've typed up a letter to send to DVLA so keep fingers crossed:rolleyes:
