View Full Version : Car Insurance Fiasco and advice seekoing!!

Hi All,

I need some advice as to what could happen and what I need to do. Basically I live in a properrty situated on a hill. I have a lack of parking space and have to park my car on the side of the road in front of the house. The road is quite steep.

On friday night my car was vandalised and taken away by police to a recovery compound for them to conduct their usual crime nvestigation.

I called my insurane company, explained the situatin and they in turn are dealing with the claim etc. I was due to be getting a courtesy car in the next few days whilst the damage etc is being assessed. However, and I kid not, the car recovery place where my car is being held underwent an arson attack by thugs last night and all the cars being held on their premises have been scorched to a shell. So my vehicle is possibly destroyed. I am yet to receive confrmation of that though.

My questions are...

1. what would happen in terms of the claim I have already made? Could the claim be made void as I am assuming the car recovery place would mak a claim of their own?

2. will I still get a courtesy car?

3. I have finance on the car so in the event that it is destroyed, not of my own doing, would I still be liable o pay th loan etc?

I am rathe concerned as worse case scenario is i end up withno insurance assistance, no car and having to pay car finance for a vehicle I do not own!!

1. Depends on whether the garage is liable or whether you need to void the first claim and claim for fire.

2. Depends on your policy. Some policies have terms stating you'll receive a hire car, some need payment of an additional premium for a car, some will say that only whilst car is being repaired at a repairer.

3. You still have to pay the finance. If it is HP the insurer should deduct the finance from the payout. If it was a bank loan then you still need to pay it. One way around the possible loss is GAP insurance.

Thats a double whammy. I assume you could cancel your claim and then seek to claim off the car compounds insurance...? But I'm not sure...

Your car was in the compound for a reason, so they could argue that your car wouldn't have been there if it wasn't for something happening to it in the first place? Dunno...

Interested to see what happens tho! Keep us updated!

There is no guarantee the compounds insurers will pay out for the fire, you may have to claim for the fire damage from your own insurance. As the previous poster mentioned they are only liable for the damage if they had been negligent eg they could have reasonably avoided the arson damage
