apparently the garage where i have my car serviced and mot'd phoned my mum on the 5th asking for me and told her my mot was expired!! actually it runs out on the 15th!! i have not lived at the address for many years but origionally when i purchased the car i was at my parents and they had my contact details their. as i have moved around (still local) i have given them my details they have both my home no and mobile number on their database and over the years have contacted me to tell me my car was ready on the appropriate number as advised.
the garage has recently relocated out of town - my dad had his car serviced there a few weeks ago and they were empty. as i have a very unusual surname there was no doubt that i am conected to my parents - and all of us have our cars serviced and mot'd at the same place.
Surley there are DPA issues phoning my mum and telling her my MOT is out of date - it is not yet - particularly if the info is incorrect.
i have had major surgery and been told not to drive for 2 months so therefore cant get to garage for MOT, the car is off the road and has a tax disk (valid) and is insured. when i can saftley drive i will get an MOT - possibly not from old faithfull garage!!

I'm not really sure what your problem is really. It sounds like the garage are being helpful - so many people forget their MOT's - you wouldn't believe!

I guess that you maybe don't get on with your parents that well, and that this has caused some family friction. I'm sorry for that. I also hope that you feel well too soon.

I think that a friendly call to the garage would be better, ask them to update their database. People do make mistakes and it looks like they haven't updated your details accordingly.

What is the question? I dont understand what the problem is, garage have tried to ensure that your car isnt without MOT, a whole ten days early and you're goin off on a rant. Baffling

Are you sure, the message was not "due to expire"?

i have not lived at the address for many years but origionally when i purchased the car i was at my parents and they had my contact details their

Did you ask them to remove/amend you details? Did you ask them not to contact you?

I'd guess they've called and left a message with someone who offered to take a message.

I'm not sure how you think they've breached the DPA though, surely your grateful for the service. We get a letter every year from our MOT station, whilst useless to us as we plan on MOTing a month in advance, it must be great for the more absentminded.

I'm stressed beyond belief with worry over the DPA and its implications over this ... (Or is OP thinking that this could be an opportunity to sue/take legal action against the garage - we are getting to be very like the US and sue whenever we can... ) Not sure contacting your mum counts tho.........

I'm going to bed - not sure I will be able to sleep. :o :D

Perhaps if there was some sort of estrangement and she and her mum did not get on well then I would just about understand having a problem with it.

As for car being off road, unable to drive it and not used, cash in the tax disc for remaining months and declare the vehicle SORN. When you are able to drive book it in for an MOT.

the last contact i have had with the garage is at my home no for the last few years .. no longer at my parents address they know i am not there for last 8 years - to phone my mum and tell her my mot has expired - when it has not - surely this is wrong .. i dont need a sorn as it is taxed for 3 months!!

If you're not going to use it in those 3 months, you can claim back 2/3 months worth of tax (remaining full months left on it) and declare it SORN. No point paying road tax if you're not using the road

someone from the garage has phoned my mum (on a phone no that they have on their records as in-active for 8 years and told her my mot has expired - when it was still valid for 10 days!! they have had all phone conversations with me on current no or mobile for the last 8 years... they have phoned an old contact no and lied- what has my user name got to do with that!!!

i despair, they're prob only being helpful and trying to ensure you don't get a £1000 fine and points on your licence and you even say they're an old faithful garage - if you're that bothered take it to kwik fit instead and enjoy being ripped off there

if you're that concerned ring them back and ask you not to ring or contact you again

OP

At the risk of sounding rude you REALLY need to get out more or seek professional help if this *problem* really does have you in the state you appear to be in.

Really, life is TOO short.

Count to ten, take a grip and keep hold of it ;)

I use a local garage and I wish they were organised enough to offer this service. Many a time DH or I have been caught out and have had to arrange an MOT at the very last minute. I would be more than happy to get a reminder.

As for ringing the wrong phone number, well, they must have 100s of customers and perhaps they didn't keep records exactly up to date. Human error perhaps. I would just thank them for the call and ask them to up date next time you speak to them.

If you have no MOT on the car then your Car Tax and Insurance are both void.

thanks I was just going to make this point about the insurance...if the car was stolen while off the road, you may not be covered.
Also, I just wanted to say that it's likely to be a new marketing strategy of the garage. They've kept old records and are trying to drum up some business by reminding ex-customers about their deadlines. Mobile phone companies do it all the time - for example, I bought a phone from a company about 4 years ago & haven't got it any more, but they've just rung me to ask me if I'm due for an upgrade & would like to sell it to me! I think it's a bit cheeky but that's how the world works these days...

That's really not even close to being true. You may need an MOT to get a tax disc, but there's no reason why you need to keep a valid MOT during the time it's taxed. Of course, driving it (or even parking it) on public roads will be illegal, as you're required to have a valid MOT, but it's nothing to do with tax.

Very few insurance policies require a valid MOT for the car to remain insured. Mine certainly doesn't, and no policy I've ever held have. I know a small number of policies do make that requirement, but it's not an automatic thing that many assume.

Please could you post the terms of Road Taxation and the terms of your insurance which show this?

Wrong. Car tax validation doesn't depend on the status of the MOT and it's extremely rare to find a policy which states its void if there's no MOT.

I really am baffled - i cannot see what the huge problem is here?!!! A garage trying to be helpful and ringing in advance albeit ring the 'wrong' number - the message still got to the intended person.

Thankyou for giving me a good giggle though whilst reading through these posts!!!:rotfl:

DPA states that data must be kept accurate and upto date and that the data holder must not divulge information to 3rd party.

Whooop di whoo... they phoned your mum and told her your MOT was due to expire (or incorrectly said it had already expired). A small mistake by a faithful local garage that may (or may not) be well versed in the Data Protection Act of 1974 (Amended in 1998)

Consider that you were not aware your MOT was due for renewal in 10 days (like alot of people do forget even though it is their responsibility to know ths)... the garage phoned up to let you know in good time but because you weren't they they didn't want to tell your mum to even pass the message on, who the call was from or what it was regarding.

About ringing the incorrect number, you stated that you have same surname as your parents, your family gets their cars serviced their and your dad has just recently been in. The garage only had to do a search using surname to cause the mixup... easily done!

Alot of people come on this site to contribute and seek advice as well as to better themselves financially and to find bargains (amongst other reasons). This just semed like you wanted to rant and vent your frustaration somewhere.
Move on!
